Stop and think for a second here - you're working as a clerk for what $6.00 an hour maybe? I wouldn't get physical with any thief. Call the police, you have security cameras. Yeah stealing is wrong, but I'm not getting in an altercation for $6.00 an hour . And guess what, I'm not gonna be facing manslaughter charges either.Leave a comment:

Something might have been damaged in his throat from the choking.Leave a comment:

Cop on the seen called it an accident and the guy wouldn't calm down, 3 other passers by had to help the clerk. Police officially ruled it an accident till people started complaining.
So for political reasons it may go to trial, but what a hard case to prove. Officer on the scene "did you think it was wrong what happened" Officer "no". Thee other persons on the scene "man it took us all to hold him down" we were really scared if we let him loose".Leave a comment:

Remember when the word accident still existed.Leave a comment:

yeah but he was nobody to touch the guy as a clerk..maybe a security guard or something but the clerk is no one , I bet there's nothing on a cvs thing that says the cashier should go after and physically stop a shoplifterLeave a comment:

It said the guy died 45 minutes later.
My question is was he choked into unconsciousness and then died 45 minutes later ?
Or was he choked, seemed fine for 45 minutes and then keeled over ?
Seems weird to live for 45 minutes and then die from choking.Leave a comment:

He got killed because he stole and then fought when trying to be held for the cops. Took the clerk and three other people to subdue him, at that point its everyman for himself. He was fighting the clerk. Clerk did what he had to do at that point.Leave a comment:

First night as a barback/doorman I jacked a guy with my forearm under his chin for snatching ten bucks off the bar. Bad things can happen in an instant that you never intended.Leave a comment:

Why did he decide to steal crayons?
Maybe he couldnt afford to buy them for his kid?
Who knows?
Daddy got killed getting you your crayons.
Would that change anything?
Daddy killed a guy stealing crayons.

sad yes, but what if the roles change ,and the clerk is dead, Over meaningless items , would it more of tragedy ? think about it and what would you want done to the criminal ?and the family of the dead clerk who was earning a living.
he dead because he stole ,he dead because he committed a crime.he dead because he was not brought up right. He's dead because he choose a path that was wrong .he's dead because he did something criminal that cause his death. He's dead because he is not a victim.

Hmmmm....
This is another one of them things that we’re missing a WHOLE LOT of info on. Choking out a guy for some crayons seems extreme, so I’m thinking there’s more there. Like maybe the place had been held up before and the clerk was wired about it. Or the clerk is naturally high strung. Or has some kind of issue. On the down-side for them, I’m pretty sure choke holds are illegal. (‘Course there’s even odds the clerk just sorta freaked, grabbed what they could and inadvertently choked the guy out. Most people have no clue how to actually pull one off.)
Then there’s the question of why the guy was stealing crayons and toothpaste. Death seems like a harsh sentence for such a crime; but it’s possible the event was a conjunction of unfortunate circumstances. (Rendering Kyser the unluckiest man ever.)
The part that kinda bothers me is the ex-wife. I don’t know too many exes who put that much effort into supporting their former spouse. But it is possible they parted on amicable terms and she genuinely misses the guy. It’s also possibe she’s posturing for a civil suit.
