For many years I thought Perez designed the 80s version of brainiac, it turned out it was Ed Hannigan. (another underrated artist).
I think Ellison sued because maybe elements in the story were his? Im not sure. If anyone knows the name of the story let me know because ive always wanted to read it.

Yeah, see the Outer Limits episode "Soldier" Ellison wrote it and it involves two time travelling warriors on opposite sides of the fence.

Perez did design Luthor's battle armor which debuted in the same issue of Action.
Im very fond of the Superman stories of that time period leading up to superpowers.

Ellison ends up suing someone over this often enough... Or at least going after them. Bill Mantlo cribbed it for a story in the Hulk, and Ellison settled for a credit and lifetime subscription to Marvel comics. James Cameron didn't fare so well, having actually gone on record saying Terminator was influenced by two outer limits episodes, including Soldier.

Hugely disappointed by the Kid Flash Fashpoint mini which was supposed to be a huge tie in to the main storyline. Particularly since it dealt with a potential Brainiac future. It just kind of felt like filler all around.
I really cant understand how he can sue over something thats influenced by something he wrote. Everything is usually influenced by what came before in one way or another. You dont see Bram Stokers estate going after everything thats remotely similiar to Dracula. Its one of the most rehashed ideas in literature. If they did they did they would have a busy set of lawyers...

Dracula has been in public domain a good long time.
The novel has been in the public domain in the United States since its original publication because Stoker failed to follow proper copyright procedure. In the United Kingdom and other countries following the Berne Convention on copyrights, however, the novel was under copyright until April 1962, fifty years after Stoker's death.[9] When F. W. Murnau's unauthorized film adaptation Nosferatu was released in 1922, the popularity of the novel increased considerably, owing to the controversy caused when Stoker's widow tried to have the film removed from public circulation
The "smoking gun" was that Cameron himself admitted the influence of the Outer Limits episodes... Which was enough for Orion to settle with Ellison, and give him a credit in subsequent releases of the film, in TV, home video etc. Otherwise Orion told Cameron that he'd bear the cost of the lawsuit if Ellison won. So it never actually reached the courts.
