Mezco did WHAT?!

    I'm the one who canceled the order because I paid for the things IN FULL on June 14th, and to date they had not shipped anything, given an update, NOTHING. So I called them and all I got was an "I don't know".

    They had $252 of my money for almost three months, and "they don't know" when I'll get my figures?

    It's not like I changed my mind and didn't want the figures...they weren't delivering and couldn't even answer when and IF the figures would be delivered.

    To hear it's happening to multiple people is BS...I'm calling my CC company tomorrow. This ain't over.

      16 CFR Part 435
      RULE SUMMARY:
      The Rule, issued in 1975, requires sellers who solicit buyers to order merchandise through the mail, via the Internet, or by phone to have a reasonable basis to expect that the sellers can ship within the advertised time frame, or, if no time frame is specified, within 30 days. The Rule also requires that, when a seller cannot ship within the promised time, the seller must obtain the buyer’s consent to a delay in shipping or refund payment for the unshipped merchandise.

        They delayed their product....they are required by Law to pay you back IN-FULL

        You bought them Paypal right? Dispute it and Paypal will refund your money

        I have already had to dispute against Mezco before with Paypal because of delays and I got my money back from PP

          Mezco's disclaimers on their website:

          A non-refundable deposit of $40.00 per item is due today and will be charged to your card within 48 hours.

          Items on pre-order can ship anywhere from two to ten months after your order is placed. It's important to note that:

          Pre-orders placed with a credit card are not charged until the items arrive at our warehouse. We'll send you a reminder email when we're getting ready to begin processing your pre-order items.
          Pre-orders placed with PayPal are charged immediately, so you'll see the transaction show up right away. Please see PayPal for details and any questions. We'll send you a reminder email when we're getting ready to ship your order.
          Pre-orders with declined or expired credit cards: Mezco will attempt to contact you by email for updated card information, if your card is not updated in a timely manner you may lose your pre-order reservation.           It seems like a crappy policy, and I get why Dwayne is ticked. But I don't see anything illegal here. It looks like they spell it all out up front, and they are still within those specified terms of sale.

            Not that I have any special information about Mezco, but one of the largest shipping companies in the world did file for bankruptcy on 31 August, "leaving an enormous amount of cargo stranded at sea."

              This is disappointing news. I've only preordered products from retailers of their products because shipping was less, but I'll certainly think twice about ever ordering directly from them again. They're missing the fact that the actual product made isn't the only factor in deciding what to buy. There's too many other ways for us to spend our money.

                    Just got off the phone with Mezco and got a full refund of $252.88 I told them I wasn't paying a deposit for items that were never shipped to me. I gave them two options...give me my money back or I report them to my CC company and THEY give me my money back. Just like that their "non-refundable" deposit disappeared.

                    Score one victory for the consumer!

                        Thanks...I'm going to try and keep up with Star Trek and Universal Monsters, but that's it. I might go for the classic Kirby Red Skull too.

                          Yeah, I'm dealing with some of the fallout at work regarding Hanjin's bankruptcy. There is a lot of stuff that was shipped out of Asia that may be stuck in the water, at a port or in a warehouse for a long time until everyone figures out how they are going to get paid. A lot of companies dependent on timely delivery of overseas merchandise are gonna get screwed over this.

                                Good. I was actually in a Twitter DM debate with them over this. I wanted to read the rationale as to how they can keep a deposit and cancel the order. He got really abrasive, really fast after I asked he clarifies that the non-refundable deposit "applies to me cancelling the order, right"?

                                Reading their feed, it appears they've done this to a lot of people, especially over the SDCC offers. Lot of money on the table....
