I think the Super Friends Property was tied up,.. thats why DC Direct could never make Him,.. However Since Mattel is now Making JLU Super Friends figures,.. they Obviously have the rights somewhere's ...
This version of the Toyman shouldn't be tied up with ANY rights with the Super Friends....he existed in DC Comics PRIOR to that year of SF with the Legion of Doom.
But he was such a short lived version (Jack Nimball replacing Winslow Schott) that besides Super Friends he really hasn't been around much, except in everyone's hearts and memories I guess. That's probably why he was never made early on but DC seems to be embracing some of the properties/characters they may have shyed away from a few years prior, such as the Wonder Twins.
He was a DC Direct figure but that's because Alex Ross choose to incorporate him in "Justice". (Even though it was a disguise for the pudgy Winslow Schott...). Once they got to that wave, and almost everyone else was done, we finally got a Toyman.
