So I should cut her a break for her art, but she can steal mine? Sure, my Joker shot is nothing special and basically a catalog shot, but I am a pro photographer who shoots for a toy company, has had my work published and used on products. I require compensation for my work to be used commercially. Laws aside, anyone in the arts knows it is rotten to steal someone else's work without permission. Anyone that knows me, knows I support other artists. I do sometimes allow shots to be used for free, depending on the project, but definitely require credit. If they had contacted me, and it was a project I believed in, I may have worked with them. They didn't bother to contact me about usage. It is no different than if I stole her words and used them in a book of my photography. Would that be right, and would you expect her to let it slide?

I can see why you'd be upset. I suppose they would argue that they altered the photo enough to constitute a new work, but there has to be honor among geeks.. They certainly should have run it by you first!
