in 5 Doctors one of the enticements offered to the Master by the high was a new regeneration cycle if he helped them to save the Doctor so that established the ability "overwrite" the 12 regneration limit created by Bob Holmes in Deadly Assasin (which was a device for his plot). For all we know (and my yet find out in the special) the master got his new batch of regenerations as part of an enitcement toget him to join the timelord cause.
I'm not even making a jusdgement about how the Master got the ability but he did get it somehow so there is a way to bypass the limit
even in the classic series they sometimes ignored ideas and limitations form earlier produciton teams (the state of temporal grace for instance), the idea that the Doctor built the ship (unearthly child and the chase), or the fact that every time the cybermen apeared they had new weaknesses (tenth planet it was radiation, Troughton era it was cold on telos, Revenge of the cybermen - gold, etc)
