Has anyone from a comic book movie ever been nominated before?

I think he will be nominated. If not, then the academy is going to come across as callous and even more out of touch with audiences than they seem to be now. I don't think he'll win though.

I appreciate your optimism, but They are completely out of touch with the mainstream. I think they wear that like a badge of honor.

Considering Ledger has already been Oscar nominated, and his performance in Dark Knight has been pretty much universally praised as fantastic, I think that will trump whatever comic book movie bias is still out there in Academy circles.

Remember, this is a post LOTR/ROTK truckload full of Oscars world we live in now.

Ledger was good and scary and convincing as The Joker. But I knew I had heard that voice somewhere before... he was doing a Rainman impression...

If you look at history, you'll find that death of an actor does not give any edge to winning an Oscar. At the very least he'll get a solid nomination for one. Winning an Oscar comes down to what kind of heat the committee takes to make that choice. The genre itself has always been ignored, but if there is enough public outcry for him to be recognized, I believe he will get one. Honestly I think director Nolan is just as deserving. His treatment is what ultimately makes everything come together. A brilliant movie from a brilliant director.
