So what does the crime he committed (manslaughter) get him? If he killed somebody for stealing, he was committing a crime.
Was he a professional or trained to restrain somebody in a stranglehold? Probably not.Comment

has yet to be determined.
It is apparent, however, that the clerk didn't just approach some random guy
and then killed him. He approached a guy who was in the process of
comitting a criminal act. My guess is that when this clerk approached this
shoplifter, he wasn't thinking "That guy's stealing stuff...I'm going to kill him
for it." He was merely acting against a criminal in the heat of the moment.
Involuntary manslaughter?
I wouldn't be surprised if there was a certain amount of charges against this
guy...but, in my opinion, from what I've heard so far, his actions were more
than justified. Its like what I said earlier about a robber coming into your home...if you shoot him dead...I guess you may be liable for something
but what you did, as "extreme" as it was, still makes perfect sense."No. No no no no no no. You done got me talkin' politics. I didn't wanna'. Like I said y'all, I'm just happy to be alive. I think I'll scoot over here right by this winda', let this beautiful carriage rock me to sleep, and dream about how lucky I am." - Chris MannixComment

Well, for once I actually agree with Lonnie. Whether you steal bubble gum, tooth paste or a million dollars, stealing doesn't justify getting killed over it. Whatever the clerks intentions he's at least guilty of manslaughter and he'll most likely do jail time. And all that over crayons and tooth paste."...The agony of my soul found vent in one loud, long and final scream of despair..." - Edgar Allan PoeComment

The fact is, the guys dead.
The clerk killed him.
Is subduing a thief in a strangle hold reasonable?
What was the off duty cop doing while this was happening?
Having a chuckle?
For sure details that might change opinions are lacking from this small article.
Working in a store does not exempt you from being a whacko.
Personally,I would not return to a store that had a murderer as a clerk.
This is my 2 cents worth.
Spend them any way you like.Last edited by jp1969; May 14, '10, 5:08 PM.Comment

I was told a story once about a young Marine who accidently killed his sister while showing her some of the holds he learned in Hand to Hand Combat training. A lot of those holds are considered aggressive. That may factor into any judgement that could come down if this goes to trial.
I realize that the the deceased was black, but was unaware of any mention of the skin colour of the security guard, or investigating Police Officer. Would it change the dynamic of the situation -- and the investigation -- if they were black? I would hope not. The reason why I ask is because of a taser incident here in Canada. The Police were white, the victim was white; there was no need to put forth racial intolerance as a motive. It was ruled as a use of inappropriate force.
This choking situation definitely needs to be investigated.90, Joe 90.... Great Shakes : Milk Chocolate -- Shaken, not Stirred.Comment

I hate thieves as well, but not for something like this...breaking into a home, snatching an old ladies purse, stealing a car or robbing someone at gun point yes. But stupid **** like crayons or tooth paste or anything at CVS I don't think so"Time to nut up or shut up"-Tallahassee

Hmmmm....
This is another one of them things that we’re missing a WHOLE LOT of info on. Choking out a guy for some crayons seems extreme, so I’m thinking there’s more there. Like maybe the place had been held up before and the clerk was wired about it. Or the clerk is naturally high strung. Or has some kind of issue. On the down-side for them, I’m pretty sure choke holds are illegal. (‘Course there’s even odds the clerk just sorta freaked, grabbed what they could and inadvertently choked the guy out. Most people have no clue how to actually pull one off.)
Then there’s the question of why the guy was stealing crayons and toothpaste. Death seems like a harsh sentence for such a crime; but it’s possible the event was a conjunction of unfortunate circumstances. (Rendering Kyser the unluckiest man ever.)
The part that kinda bothers me is the ex-wife. I don’t know too many exes who put that much effort into supporting their former spouse. But it is possible they parted on amicable terms and she genuinely misses the guy. It’s also possibe she’s posturing for a civil suit.

sad yes, but what if the roles change ,and the clerk is dead, Over meaningless items , would it more of tragedy ? think about it and what would you want done to the criminal ?and the family of the dead clerk who was earning a living.
he dead because he stole ,he dead because he committed a crime.he dead because he was not brought up right. He's dead because he choose a path that was wrong .he's dead because he did something criminal that cause his death. He's dead because he is not a victim.
