Yes the UCMJ does include the death penalty but it hasn't been used is decades. Also from his prespective death is a martyr death caused by his enemy in the cause is a way to eternal bliss. No life in prison (peferably in a small cell) where his only outlet is chained to break up rocks (i can say definitively in the 90's the army still used chain gangs to break up boulders into gravel at Ft leavenwoth I hope they still do) or scub latrines by hand is a harsher punishment.Last edited by jds1911a1; Nov 9, '09, 6:46 AM.Comment

If military crimes fall under the umbrella of a federal crime... then yes, if the crime is treason.

The SRC process is what I just got done with doing here at Fort Lewis (flying overseas in a few weeks..). It's a pretty busy process, lots of long lines of soldiers, getting all their medical/finance/legal records checked.
Hate to say, but unfortunately as we've seen, he picked a pretty vulnerable spot to go nuts.
My sympathies to the families left behind.
