Ok, so stripping the poorly worded answer I received down to its core elements, them not going into production right now, doesn't mean they won't ever. They could show up in future waves when they're ready to go.

The Batman from the recent movie is out, too. I can see the Oompa having a body problem as we have yet to see a child body in the new format. But Penguin is said to feature an actual new fat body, so I don't see that as a problem for the others.
