Is the GA Batman Legacy figure a K-Mart exclusive?

I saw an ebay auction for this figure with a big "K" sticker on it, like all the current K-Mart exclusives? Is it K-Mart only for now?

I read as far as the 1st release goes ... yes, then they will move onto other retail chains, like wave 15 did ... However Batmite, Might actually only be packaged with Batman at K-Mart.

I have yet to see these here..., I really want Catman more than Life Itself ... But them Ebay Prices are insaine.
