I've been having a problem with a seller on eBay - he seems to sell mostly Mego toys so I'm guessing he either is a member here or his friends are - or at least some here have had dealings with him. I purchased a MOC Mego Star Trek Kirk figure with pink lips on 6/11/18 from - thedraftsman (from moosetown) - eBay #192564936842. The toy arrived with obvious damage to both the figure and the packaging that had been intentionally concealed in the auction listing (most notably a large paint rub in the hair at the top of the forehead which had left a couple of brown paint smears on the inside top of the bubble, and a large number of scrapes, creases, and filth on the card - see attached photos.) The seller advertised this as being in perfect condition, none of what upset me was visible in the auction pictures or mentioned in the auction description. I wrote to the seller and told him I could not accept the toy as it actually is - from his first response he pointed out no returns and became extremely belligerent towards me. I was forced to file a complaint with eBay where they provided me with pre-paid return shipping (at which point thedraftsman threatened me with physical violence) usps tracking # 420788619301920130200516353908 . The toy arrived back to the seller on 6/27/18 and he resold it with no changes to the auction title, photos, or description on 6/28/18 eBay # 202352559237 . I also reported the situation to my credit card company - which apparently was my mistake - since after eBay ruled in my favor the case was closed and handed over to mastercard. Mastercard issued me a temporary credit until thedraftsman told them that he had not received the toy back. Luckily, I saved all receipts and documentation of the transaction which I forwarded to my credit card company - and was then told they are now attempting to get my money back from his bank - and was advised by mastercard that I should file a complaint with the USPS mail fraud department as this is a very obvious case of criminality. Over 2 months later and I have yet to receive a refund. This is clearly a situation where eBay feedback score is not an accurate gauge of the sellers integrity. KIRK04.jpg this is also my photo - the toy looks pristine if you photograph it from only certain angles. I think he also only used low res images. After I complained, thedraftsman kept telling me condition wasn't so important - that i was "nit-picking" and he used the - he's not a professional grader defense (like any of this is an excuse to steal my money.) thedraftsman also said this was all my fault for not asking him beforehand if he was honest and asking if the toy had any condition issues not revealed before purchasing. like I said feedback score means nothing in this case. At the end of the ebay complaint case he kept telling me he was a "winner" he "always wins", that's "what he does. kirk06.jpg the only change seller made to the description the second time around was that "someone sent an offer before asking a single question" . I did more than make an offer. I paid, received and returned in same condition as received.
