I thought the Mego trademark application had been rejected by the USPTO based on Lego's opposition. Are there some new developments on this issue?

In looking at the site, I would note that it says patent pending, which likely relates to the technology behind what they are offering. I didn't see any (R) - registered trademark symbol next to the name mEgo - but even if they did go down that road I guess the question would be whether there is consumer confusion between the mark used in the context of toys (Lego) and the mark used in the context of whatever mEgo is offering through their site. Some marks are so famous that the USPTO could still reject a trademark application even though it relates to another industry based on a claim of dilution.

What about this one? It steps on some toes too, but these guys have been in business for years? They don't know anything about the original Mego either until I mentioned it to them a while ago..the names just a coincidence.

The way I undertsand since the site name was not only bought first and at a time when the Mego trademark was inactive they have equal if not more right to it. If Mego had been active at the time it's a whole other ball of wax. In a similar vein if someone bought heroesworld.com tomorrow they would in effect own it, since it the mark is inactive. Most larger companies will
simply make the owner a good offer and be done with it. A true cybersquatting case (where the mark is already in use) is another matter.Comment
