    Car Accident Thread

    I'm throwing this out to you guys.

    I was driving to work and a person was parked in a Bus stop in front of me, on my right, at least 12 inches out from the curb and opened the drivers side door as I approached. I tried to swerve left to avoid a collision but got clipped and got my passenger side scraped and the other car's door tore off my passenger side mirror. Their car and mine sustained damage, mainly to the doors, where the edges of the metal is peeled or folded back a little. My Ins. agent said they were definatelty wrong to open their door into traffic. I have not heard from the other person yet. No one was hurt, no air-bag deployment, and she seemed reasonable. I don't think she is going to make a big deal out of it, meaning, claim it was my fault and make me pay for the damage, etc. Anyone had an accident similar to this? What happened to you guys?

    If their deductible is like $500.00 (many are) I suspect you might not hear from them at all.
    If anything, THEY are probably more worried if they're going to hear from you.

      Were the police called? If so,make sure you get a copy of the accident report.

      If any claims are made they ins company will take a deposition of all parties involved, and use that plus the police report to find who was at fault.

      But you can usually look at the police report and you will get a idea of who the officer thinks was at fault.

        It might come down to what her ins. agent or others advise her to do. I've never dealt with this situation before.

          Sorry to hear about your accident, Hopefully you got a police report, If you didn't then both ins companies will fight amongst themselves pointing fingers, On the bright side no one was hurt and cars can be fixed a lot eaiser then a person

            My wife when we were dating, opened her door into traffic and had it folded backwards. It is totally her fault. You should have no deductible at all. They are responsible for making sure the road is clear before opening their door. Her insurance should pay for all damage to fix your car. See ya Thursday.

              Ditto. Always no matter how small, or how much they beg, get a police report. Maybe you did, I don't know, but I wanted to throw that out there for others. I think you have a certain amount of time to file the accident report with the police, but maybe it varies from place to place.

                  The other driver contacted my Insurance Company and took %100 percent responsibility for the accident. They'll do an estimate Monday.

                            Being a Police Officer I also concur. The party who opened the door into traffic is responsible for the accident. ALWAYS get a police report, it protects you and gives you some muscle with the insurance companies.

                            I'm glad she took responsibility, and no one was hurt.

                            I just recently opened my patrol car door as another officer pulled up next to me. It tore up ywo cars, and I was at fault and I knew it as soon as the collision occurred.

                            Go ahead and laugh its OK, I can laugh at it now.
