More Ebay Feedback Talk -- ebay RESPONDS

Just found this thread on the ebay boards.

It's interesting because a rep of ebay actually responded mutiple times to the thread.

eBay Forums: Are the new feedback changes legal? ...

I'm not buying it, I've run into too many ****** nozzles in my time to think it's going to be used fairly.

Wow, I don't think I ever saw a "pink" participate so much in a ebay forum thread.

      One of his points:

"There's a good proportion of buyers who don't know what positives, neutrals or negs do. A third of eBay buyers had never heard of DSRs (the concept, not the name) in a recent survey we did, so I wouldn't overdo the idea that everyone who leaves feedback knows what its impact is."
And a response from a seller:

"So people who have no idea of what they are doing can take actions which damage the livelihood of sellers?"
I agree that this is a potential big problem right there. For example, in the real world, giving someone 4 out of 5 stars for service is pretty good, but with ebay's DSRs, a 4.0 rating isn't considered too good according to their seller policies.

I agree. Both buyers and sellers have used feedback against me in the ten years I've used Ebay. Only a few months ago I had to pay the $25 mediation fee to have a neg looked at. A NPB neg'ed me after I filed the NPB. I didn't derserve it and it was removed, but with this current policy, I couldn't point out what a con artist the guy was and he would go on screwing with sellers.

Neutral should be just that...nuetral. Why are they construeing neutral as bad? Neutral is just that, not good, not bad.

I'm just wondering if the guy has a point with his comment it might not be legal changing the feedback.

We all signed an agreement when we joined...

Unlike Mego Museum who doesn't deal in money, so they can change any agreement at will.... ebay TAKES OUR MONEY.

Can they change the rules and take our money at the same time ?

If so, their contract (agreement) means nothing

Don't they (Evilbay) have some kind of B.S. clause in their contract about they reserve the right to change/update their policy whenever they see fit? In other words you the user are bound in stone by their contract terms and Evilbay can change whatever they want whenever they want and when they feel like it. ??????

In other words their motto should be "just shut up and give us your money". Do not do as we do just do as we say.

But if that's true, what could stop them from raising the listing fee's to $1,000 per auction and retrograde the fee's owed for the last 6 years ?

Scary thing is that they probably could. However, it'd be really hard to take every seller to court and get the judgement (I wouldn't pay!), it'd also be the subject of a massive class action suit (that ebay would end up losing), and people would generally NEVER use ebay again. I wouldn't look for something like this.

On the other hand, these small, sneaky little things that ebay (and other big corporations) do generally go unchallenged. When people do band together and file suit, the company usually settles (see this Netflix flap from a couple years ago) quietly with terms that end up in their relative favor.
