    Paypal Friends and Family

    I know we are a very trusting community which is pretty rare and wonderful thing in this day and age... but what if someone receives money for goods through PayPal's Friends and Family/Gift option and never sends the item(s) you purchased. Do you have any legal recourse to get your funds back? I would think emails and texts would be admissible proof, but I honestly don't know. Any input on this would be appreciated.

    Proving what? That you committed fraud? It is only my opinion but I'm thinking there's no recourse if item is not sent.

    EDIT: Not you necessarily, but anyone. I assumed we were speaking in generalities here .

      We are speaking in generalities. To me it can be looked at in a different perspective. Someone agrees to give you something and you agree to give them money --tit for tat. There's generally a negotiation in which terms are agreed to. The only problem is that the payment method chosen to avoid ungodly fees nullifies the transaction. I just want to know if there have been any success stories in which someone has been able to reclaim their money and how they went about it.

        If it's an ebay issue and you never received item after paying, you can open up an ebay case file
        and the seller has to have proof they sent confirmation tracking with the item, you can ask if tracking
        was sent with item, if not then ebay should refund the cost back to you.

        If the seller said they did send with tracking, then you can ask for the tracking number, if they cannot
        produce tracking info, then ebay should refund your payment.

          you are using the gift option to get the seller around the fees, and also any protection that you get from paypal when you pay for goods. Paypal considers it sent as a gift. BTW, as the sender, Paypal sticks you with the fees if you choose the gift option or friends and family, unless its from a Paypal balance.

            I'll be honest about this gifting thing. Paypal is a great service because the money is guaranteed to the seller when this processes. I think any personal hang-ups over the fees should be calculated in with whatever someone wants with their purchase and allow the buyer to have the standard protection the seller gets. A few dollars here or there should not resonate so badly on the seller that he needs to ask the buyer to take a risk of no protection should he/she not get the item. If we're a trusting lot as stated then follow the rules as laid out. As a seller ask the price that accounts for fees and operate under normal guidelines. Off my soapbox.

              I agree. I use my bank account to avoid fees and make it convenient for the seller to collect payment quickly and without fees as well. So we're basically still at the same place, no one here has ever been able to win a dispute and get their money back through PayPal? What if the funds were drawn from a credit card instead? Would the fraud protection from that card be able to make PayPal concede? It would be your credit card company vs. PayPal instead of you against the seller and PayPal.
