Getting back to the interview I saw with the Gov. this morning he did mention that it would be impossible to enforce such a law and even went as far as the apologize for bringing this up after being told that bringing shame to the obese by being refused sevice in a restaurant was the wrong approach.
I don't think of what my company as a bribe. There is no pressure to participate if you don't want but from an economic standpoint, they would prefer to give a cash incentive to stop or pay for gym memberships because in they know that the money that they would pay out will more than pay for itself in reduced health care premiums. I'm really not sure if they charge higher health premiums for smokers vs. nonsmokers...I know the life insurance premiums are higher.

I guess technically you could call it a bribe but I look at as more of an incentive...again, no one is twisting anyone's arm or telling them they can't smoke or be overweight.

My particular company has a disproportionately higher % of smokers than the norm. I would say close to 40% of the employees in my company smoke.

        Yeah, just look at this:
Farm Bill favors the foods that make us unhealthy - RecordOnline.com - The Times Herald Record

By the way, I believe the original Bill was not expected to pass:
"...please, don't be offended. He says he never even expected his plan to become law.
"I was trying to shed a little light on the number one problem in Mississippi," said Republican Rep. John Read..."

        Whatever that means.

Over here in UK land you can be refused treatment on the NHS if you are overwieght or a smoker...yet even if you are healthy and have to undergo surgery you have to sign a consent form in case things go wrong!?!?!?! So why not treat them if you have to sign the form anyway????
