    Texas Teacher assault

    Very happy that my assault case finally received media attention after fighting with school district for over a year.

    Also extremely greatful that Texas SB 1544 has been introduced by Senator Dan Patrick so I pray that in the future no other teacher/family goes through what mine has the last year with Assault Leave being denied!

          Yet less than a month later, on March 2, 2010, Spring ISD reaches a different conclusion saying, administrators "do not believe that this incident was an assault."
          That's absurd. What would they consider it, then? Hang in there, and I hope it all works out for you.

              How can they deny it was an assault? That's just asinine.

                I think the reason they are saying it was not an assault ( if i have read and understood it properly ) is that there was no intent on the part of the pupil. It says he tripped and fell into the teacher, knocking him over, that would be classed as an accident.

                I apologise if i have misunderstood it and i hope everything works out well for you.

                  That is what I thought also,there is a big difference between accident and assault.
                  I hope you have or will have a full recovery with no lingering problems

                    Thanks everyone. My wife and I are lobbying to get the law specifically written that when an assault occurs the school district must abide by the court ruling, regardless of what the school district ruled.

                    Just to clarify, I was the one tripped and shoved by the student. The student plead guilty at the hearing and was charged with Assault on a Public Servant; but that was not enough for the school district to change their ruling.

                        Well if you were delibratly tripped and shoved by the student who then went on to admit it in court then that should be game set and match to you.

                          Being deliberately shoved and pushed by some snotwad of a fourteen year old is assault, and if the school district refuses to see or admit that, then they are either grossly incompetent, hopelessly out of touch, or completely stupid.

                          More likely all three at once.

                          Sorry to hear you had to go through that Charles, you and your wife have my condolences.
