Jose Martinez is also suing for negligence, emotional distress and liability.
Emotional distress? What BS. Only in America do people sue one another over absolutely nothing. Over here the parc would've given him a free ticket for the whole family or something and a sincere apology and he would've been happy with that

they should impose a law that anyone who files frivolous lawsuits has to pay all legal fees involved for both parties and the court system

It didn't sound like he was in any shape to be there to begin with. And how did he know what his blood pressure was at that exact moment? I imagine everyone's blood pressure was elevated at that point. Sheeesh...Bozo.

I wonder if they ever finished fixing that ride. There was an article last year about it not being a small world anymore. With the patrons getting fatter the ride could not handle then any more!

And a lot of states are starting to pass laws to charge the losers. Like it would stop any, but its a start!

I have felt the same way for years. If you lose and the judge decides it was frivolous you pay.

This lawsuit is VERY valid! Coincidentally, the other day I bought a bag of cherry Life-Savers, only to find a single GRAPE LS at the bottom of the bag!! This is NOT acceptable at ALL.....I have already lawyered up...
