    PayPal question

    I have a British ebay buyer saying he never got the figure I sent him. I told him I have the customs form with the tracking number, so I tracked it and it says it's somewhere in the UK. I forward him this info, and he files a claim with PayPal. My question is; Having proof that I sent the figure out to him, can I still lose this claim? I've NEVER won a Paypal case when the buyer has complained about the piece he got (not as described or whatever)... But this time, I have proof that I sent it.

    Thoughts?

    If the claim is item not received, then I don't think you can lose. I would send paypal all the info.

      It might be worth contacting whomever you sent it with, to determine if the delivery address matches the one you sent it to. If not, you may be able to claim insurance from the postal provider. If the tracking number proves it reached the correct address, I think Paypal would side with you.

        From what I understand, a custom's form number is not an approved tracking number according to Paypal. More than likely, you will lose the dispute--but hey, who knows? Maybe you'll get lucky......

          If paypal will not confirm the address in the country of arrival, then you automatically lose the claim. Had the same happened to me sending a protools set up to a buyer in Germany. I fought the decision and if it wasn't for the fact that the buyer emailed me to complain about how much he had to pay to get the computer system out of customs, I would have lost the appeal... I forwarded the email from the buyer WITH the headers. I figured if he was complaining about paying customs fees to receive the item, chances are he RECEIVED the item. Paypal contacted him about the email and he fessed up that his claim was because he was mad about customs fees.

              This is why I don't ship outside the US with ebay purchases. I had a few transaction go fine, but two of them went VERY bad. I sent them and they got hung up and the tracking showed the packages somewhere, but not delivered, so the buyers filed complaints with paypal and got their money refunded. THEN the packages get delivered and the buyers have my money AND the stuff. Neither felt the need to either send the package back to me or resend me the money.

              I really hope that it works out for the good on your transaction, Sandy. I don't feel what happened to me is a common occurrence, but it did happen twice and I was really mad at myself for not refusing to ship outside the US the first time, which caused me to get hosed again.

                  it is a common practice bro, it's happened to me with people from France,the UK,Brazil & Mexico

                  of course i've been screwed many times by US buyers as well but more often it's the over seas guys

                      If you sent it International Priority Mail you're probably safe. If you sent it First Class International you're probably SOL.

                        proof that you sent it is not proof that it was received. So, unless you sent it in a manner in which you could track or insure it you will probably lose a paypal claim.

                        Bright side: if this was an ebay deal and the buyer gave you a neg, I believe you can have that removed for international transactions in situations like this. Doesn't really help with the money and time put into the figure, but at least you don't have to carry an ebay scar.

                          I don't know if Ebay clearly explains this but ownership doesn't transfer until the item is received by the buyer. That means it's up to the seller to pack it well, ship it with insurance if you don't want the risk, etc. I really don't sell much but ultimately, I make the decision as to whether or not I want to insure it. That's where I think sellers make big mistakes all the time by cutting corners on shipping especially high ticket items. Usually if it is below $50 I'm ok with delivery confirmation and if it gets lost; I'm willing to eat it. Above $50 and I insure it...whether it is out of my pocket of the buyer. That's a reason I generally don't ship out of the country. It becomes cost prohibitive to many buyers but I'll open up an auction to an out of country bidder as long as they pay for shipping and insurance.

                            if you have tracking for it using priority international then you should be ok. but you never know with paypal...they're effed up in the head!!
