    Warning Regarding FedEx

    I just wanted to give everyone a head's up regarding using FedEx Ground for expensive items.

    Apparently, they have changed their policies recently and for most items, they will only insure up to $100 which is ok if that's what they want to do but the way they disclose it is unethical at best and in my opinion is possibly setting themselves up for a major class action law suit.

    I recently mailed a pretty rare S.F. 49'ers picture pennant that I sold on Ebay. I decided against USPS because I was hoping to have it more carefully handled and I generally use FedEx or UPS for more expensive items for that very reason.

    Sure enough the pennant arrives damaged, the buyer is upset and I'm upset because I double boxed the item but it was still damaged.

    I only get reimbursed $100 + shipping and no more even though I paid for what I thought was insurance.

    After I talked to FedEx and explained the situation, they told me it was not insurance it was a declared value.

    Right on the very back of their customer shipping record it says "Our liability in connection with this package is limited to the lesser of your actual damages or $100, unless you declare a higher value, pay an additional charge and document your actual loss in a timely manner."

    I ask the FedEx rep Did I declare a higher value? Yes sir. Did I pay and additional charge for the declared higher value? Yes sir. Did I document the loss in a timely manner? Yes sir. Well, if I met all of the criteria, why are you limiting my claim to $100.

    They have placed a disclaimer nowhere near this liability coverage statement that says "If there is a conflict between the current FedEx Service guide and this Customer Shippng Record, the current FedEx Service Guide will control"

    The FedEx service guide is nowhere to be found on the shipping record, at their drop off locations, and I only found it buried in their website.

    I looked at the service guide and it says packages containing all or part of the following items are limed to a maximum declared value of $100 and it lists just about everything on the planet including the vague term collectors items which to me can be construed as anything sold on EBAY.

    They were happy to collect additional money from me for a declared value over $100 but refuse to call it insurance and then hide behind their vaguely written service guide to limit their liability.

    I have learned my lesson the hard way and wanted to pass the information along to let you know that if you are sending an item by FedEx ground over $100 in value, they will only cover $100.

    In my many years of sending and receiving packages, I have found that by and large insurance is a total rip off no matter what service you use. Of course they are more than happy to take your money, but God forbid if you ever make a claim. HASSLE.

    Sorry to hear of your problems with FedEX, but it's not surprising.....

      I would file a small claims case against the place that shipped it - I saw a case EXACTLY like this on one of those Court shows and the Plaintiff won Because of the exact reasons you spelled out. Basically, if they collected extra fees for more insurance, they were on the hook (according to the Judge). The Judge told the shipper to sue (Fed-Ex or UPS, I don't remember), because of the illegal policy. If you're out a lot of money, it might be worth a shot.

        I would NEVER use Fedex ground. I sent a bunch of large boxes of stock to Florida one time that I set up at FX and they arrived looking as though someone had intentionally kicked them in and stomped on them. It is a separate company from the overnight Fedex that has the good reputation.

          as an artist/sculptor ,I ship piece all over and I learn in undergrad to pack it well and don't rely on the shipping service .
          I learned this a hard way in one of my sculpture classes in college . During our pre-final portfolio review to graduate our professor has us pick one piece and pack it for shipping as if we had sold it. understand first that we all where a higher caliber sculptors and artists and we where a group of about 10. In other words we thought we knew what we where doing..we thought.
          During our walk through he took each box and tossed it up in the air about 6' on to the ground. Of course they all broke. He told us that is you pack something and it can't stand up to a 6' drop without damage , repack it . meaning you need to learn to pack better.
          the moral to the story is you didnt pack it well. A pennant is a flat piece that should be easy to ship sandwiched between two pieces of foam core and then double boxed. I spend the extra money on packing and shipping charges to get it to the customer now.

            I disagree with you that the moral of the story is that I didn't pack well.

            If I didn't pack well, FedEx would have dismissed my claim outright....they admitted fault and reimbursed me but only the $100.

            By the way, art objects are also on the list of things that they will only reimburse for up to $100. I have had items delivered to me that look like they have been run over by a truck tire. No amount of packing is going to prevent damage like that but if you don't have insurance....tough luck....Fed Ex refuses to call it insurance...they call it declared value but charge you extra for it the more you declare so my problem is if you are only going to reimburse me $100 why are you charging me extra for the higher declared value?

            Even the buyer said the item was packed well and it appeared to him at least that someone from FedEx simply took the flat double boxed pennant and rammed it into the truck so hard that it crumpled right over the picture.

              Sorry to hear that man and thanx for the heads up,I never use Fed ex any way,I only ship USPS and UPS when it's something large

                I never use FedEx any more, first either they could never find my house and they left my packages on my neighbor's front porches. Second, they lost the package all together and then there is the joy of dealing with their customer service. Also, I tried having packages sent to my office, at the time my office was located in the local police building. They marked it unable to deliver no such location. When I called customer service to find out what the problem was they argued with me about wheither the building existed or not. By the way UPS never has any trouble finding my house and I take great joy in rubbing FedEx's face in that.

                  I ship with all 3 Fedex, DHL and UPS ground. They all BLOW!

                    Yep. FedEx bought RPS around 2000, if memory serves me right, so they could compete with UPS by offering more services in their portfolio. They rebranded the new company FedEx Ground levering the reputation of the name to get more business. I'm not sure if it's still true, but at least for the first few years, both companies were fully independent of each other--meaning you could have as many as 3 or 4 different FedEx drivers on a given route, each handling a different service, because there was no way to integrate them.

                    As for the Insurance issue, these changes started a few years back. There was a lawsuit against UPS regarding declared value and insurance. The crux was that UPS took the money for the coverage, but then denied liability, deferring blame to the insurance firm who underwrote the coverage but kept systematically denying claims. I cannot recall if they lost, or settled, sometime in 2005ish, but since then, it seems like all the freight carriers have changed how "insurance" is being handled. I worked for UPS while most of these things were happening.

                      I know for sure that within the last year FedEx has stopped asking you what is in the parcel.

                      I thought maybe a lawsuit was brought against them for invasion of privacy or something along those lines.

                      Now I am leaning towards they don't want to know so that can collect extra money and deny insurance coverage since it appears that most items would fall under the $100limited liability threshhold. The only thing they ever ask anymore is the same as the USPS..."is there anything dangerous, explosive, etc. in the box?"
