I agree that 2 years is excessive. Donte Stallworth drives drunk and actually kills another person and gets 30 days?

The purpose of prison is rehabilitating criminals. Plaxico is not a criminal, just an idiot. I would hope he learned a valuable lesson and that could have been hammered home by fines and community service.

However, I do have to shake my head at the stupidity. As another post pointed out, why didn't he have it in a holster? On top of that, it was a Glock. Glock's have no real safety that prevent a weapon from being accidentally fired, it's just a switch on the trigger. The manufacturer thinks that if someone has their finger on the trigger and pulls it, they are planning on firing it. Well, guess what, this proves that there are incidents when that is not true. Plaxico (Mexico's nephew, not cousin...) grabbed for the gun as it was falling down his pants leg and ended up pulling the trigger. Both a holster and a gun with a safety would have avoided this.

the Stalworth versus Burres aguement is common as to penalty versus crime. The crux of the crime is intent. Stalworth's was manslaughter (not a crime of intent) do I think he deserved a harsher sentance yes but sentance is determined by the laws in the locality the crime happens. burres crime was one of negligence (defence says he didn't know better) or intent (proscutor says he knew it wasn't legal and didn't care)depending on how the case is presented. the penalties are dependant on which argument the judge and jury believe as determined by the proscribed laws. the fact he had an expired permit kind of kills the he didn't know better defence

to address Burres as a gun owner, Gun control lobbyists always want more laws to limit people having or buying guns. My stance is always we don't need more laws we need to enforce the laws on the books.
NYC has the strictest gun laws in the country. in NY you have to register every firearm. The right to carry a weapon concealed is not universal (each state has it's own rules) and NYC has very tough restrictions to get that right. The right to carry in one state does not transfer to any other (you can sometimes use a license in 1 state to support a license request in another). it is illegal to cross state lines with a firearm unless you have a license to carry in both states - even Armored car drivers who cross state lines have to be licensed in both states (It was my job for 5 years. Some states (incl CA, NY, and NJ) even limit what type of bullet you can have

Plexico was dumb to put a gun in his pants (he makes more than enought to get a holster heck he could get a really nice one custom fitted).
He was puting everyone at risk by taking a firearm into a drinking establishment (even if he was not planning to drink you never know what can happen)
He was cheap - If he was concerned for his safety he made more than enough to hire a trained and licenced body guard
He was breaking the law - by carrying the gun without the license (and since Law and order has been on tv for 15 years with 2 spinoff's and is on reruns constantly I can't beleive he never heard about the NYC permit laws)

2 years might be the minimum sentance for the crimes he was convicted of. Did NYC make an example of him - probably I suspect it's his fame bringing the "standard" to light for all to see. Hopefully it gets others to be more aware when they think about taking a gun out of the house "for protection"
is it too bad it will most likely end his career sure but who knows (there are teams in the CFL or europe too). Joe Average who commits the same crime and gets 2 years has a much harder life where they may lose their home and didn't make millions first.

Guys also keep in mind that during the time this happened a bunch of high profile athletes were getting robbed at gun point, I think he was doing it for protection

But I personally grow so very Tired of any Celebrity/Sports Player/rich guy Who thinks they are above the Law & don't wanna take action(s) to abide by the Law. All Plexico Had to do , was get a Flipp'in Gun Permit like the Rest of America has too. Instead the Dude wants to Roll Gangsta Thug Like, & to me the Guy got what He Deserved. If that would have been you or I ,.. I am pretty certain We would be looking at more time.

One of our top athletes, a cyclist, has been caught using drugs twice now.
Anyone else would go to jail, and certainly be banned from sports, but no, most people applaud him and he's competing again.
He also walked away from a restaurant without paying.
