That second image definitely has the DeVito vibe. Writers and artists have been trying to do something with the Penguin since the mid 80s. Of all the Batman villains, his classic version doesn't seem to translate as well into the modern Bat-universe.
I personally loved Chuck Dixon's solution of having Penguin finally go "legit" as owner of the Iceberg Lounge. It made him more of a player and still stayed true to the old character, and his habit of faking leaving crime on countless occasions.
Penguin is one of the very few characters that seems improved in the newer versions. He just didnt have enough attitude until the eighties and i think the Devito influience helps. Joker on the other hand.....
I can see it. I think it's normal though.... artistic drift as different versions become predominant. Anyone who's made a custom comic character knows how tough it can be to narrow down one, definitive take on a character that's been around for a while.
