He's only in talks with the studio to play the role, nothing is set in stone yet and no contracts have been signed. Keaton is also set to return for the sequel (i.e. contracts are signed) and the Vulture will feature prominently as the villain in the sequel, so wither they are doing the multiple villain thing (which rarely ends up working well) or talks with Jake aren't going well.
